1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you and Solarhi Tech, with its principal office at Shop No 13, West City Trade Plaza, Bavdhan Road, Pune, Maharashtra 411021, India.

These Terms apply to all visitors, customers, and users of solarhitech.shop and to all clients who engage Solarhi Tech for solar energy installation and related services.

By proceeding, you confirm that you are at least 18 years of age, legally capable of entering into contracts under Indian law, and authorized to agree to these Terms.

2. Our Services

Solarhi Tech provides the following solar energy services:

• Residential and commercial solar PV system design, supply, and installation
• Battery energy storage system (BESS) supply and installation
• Solar energy monitoring system installation and configuration
• Annual Maintenance Contracts (AMC) for solar systems
• Solar energy consultation and site assessment services
• Assistance with net metering applications and government subsidy claims

2.1 Service Availability

Our services are available across Maharashtra, India. Availability may vary by location based on technical feasibility, regulatory requirements, and resource availability. We reserve the right to decline service where installation is not technically or commercially feasible.

2.2 Site Requirements

Solar installations require your property to meet structural, electrical, and regulatory requirements. We conduct a site assessment before confirming any installation. If your property does not meet required standards, we may decline to proceed or recommend modifications at your cost.

3. Quotations and Pricing

• Quotations are valid for 30 days from the date of issue unless otherwise stated in writing
• Prices are subject to change based on fluctuations in solar panel, inverter, and material costs
• Quotations are based on site information provided at the time of assessment; changes to site conditions may result in revised pricing
• GST and applicable taxes will be charged in addition to quoted prices as per prevailing Indian tax law
• Quotations do not include structural modifications or electrical infrastructure upgrades unless explicitly stated

3.1 Government Subsidies

We assist customers in applying for government subsidies under PM Kusum Yojana and MNRE programs. However, we cannot guarantee subsidy approval or quantum, as these decisions are made by government authorities subject to scheme availability and eligibility criteria.

4. Payment Terms

• Advance (30-50%): Due upon signing the Work Order and before material procurement
• Progress Payment (40-50%): Due upon delivery of materials to site or commencement of installation
• Final Balance: Due upon successful completion of installation and commissioning

Payment can be made via bank transfer (NEFT/RTGS/IMPS), UPI, cheque, or demand draft in favor of "Solarhi Tech."

4.1 Late Payments

In the event of delayed payment, Solarhi Tech may: (a) suspend installation work; (b) charge interest at 18% per annum on outstanding amounts; and (c) withhold commissioning until full payment is received.

5. Installation, Warranty and After-Sales

5.1 Installation Standards

All installations are carried out by certified technicians in accordance with CEA Regulations, the National Electrical Code, and applicable state electrical regulations under relevant Indian Standards for solar PV systems.

5.2 Product Warranty

• Solar Panels: 25-year linear performance warranty and 10-year product warranty against defects
• Inverters: 5-10 year warranty as per manufacturer specifications
• Battery Storage: 5-10 year warranty depending on product and manufacturer
• Mounting Structures: 10-year warranty against corrosion and structural failure under normal use
• Workmanship: 2-year warranty on our installation workmanship

5.3 Warranty Exclusions

Warranties are void if damage is caused by misuse, negligence, unauthorized modifications, acts of God (floods, lightning, earthquakes), failure to follow maintenance guidelines, or if annual maintenance is not performed by an authorized technician.

5.4 Annual Maintenance Contract (AMC)

We strongly recommend our AMC for optimal performance. AMC includes preventive maintenance (minimum 2 visits per year), panel cleaning, inverter checks, performance analysis, and priority support. AMC terms are governed by a separate agreement.

6. Limitation of Liability

To the maximum extent permitted by Indian law, Solarhi Tech's total liability shall not exceed the total amount paid for the specific services giving rise to the claim.

We shall not be liable for:

• Loss of anticipated energy savings due to variations in weather, shading, or grid curtailment
• Damage caused by events beyond our reasonable control (Acts of God)
• Indirect, consequential, or incidental damages
• Delays caused by government approvals, utility processes, or supply chain disruptions
• Inaccuracies in energy savings estimates, which are projections based on historical data

7. Intellectual Property

All content on the Solarhi Tech website including text, graphics, logos, system designs, and technical drawings is the intellectual property of Solarhi Tech and is protected under the Copyright Act, 1957 and applicable Indian IP laws.

You may not reproduce, distribute, or commercially exploit any content without express written permission. System designs and proposals may not be shared with third-party contractors without our written consent.

8. Communication Consent

By using our services or submitting information through our contact form, you consent to receive communications from Solarhi Tech via SMS, email, WhatsApp, OBD, Google RCS, and other digital platforms as described in our Privacy Policy.

By checking the communication consent box on our contact form, you agree to receive communications from My Inbox Media (R) via Solarhi Tech for:

• Service updates, installation notifications, and appointment reminders
• Promotional offers, seasonal deals, and new product launches
• Maintenance reminders and AMC renewal notifications
• Government subsidy updates and regulatory changes
• Solar energy tips, performance reports, and educational content

You may opt out of marketing communications at any time by contacting info@solarhitech.shop. Essential service communications may continue regardless of marketing opt-out status.

9. Cancellation and Refund Policy

9.1 Cancellation by Customer

• Before material procurement: Full refund minus administrative charges (2-5%)
• After procurement but before installation: Refund minus cost of materials procured and restocking charges
• After installation has commenced: No refund; customer liable for work completed and materials installed

9.2 Cancellation by Solarhi Tech

We reserve the right to cancel an order if site assessment reveals technical infeasibility, supply chain issues, safety concerns, or non-payment. Advance payments for unperformed work will be refunded within 14 business days.

9.3 Disputes

Disputes should first be raised in writing at info@solarhitech.shop. We commit to resolving disputes within 30 days. Unresolved disputes are subject to the jurisdiction of courts in Pune, Maharashtra, India.

10. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra, India. Both parties agree to attempt good-faith negotiation before resorting to legal proceedings.

11. Amendments to Terms

Solarhi Tech may modify these Terms at any time. Changes will be reflected in the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the updated Terms.

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any project-specific agreements, constitute the entire agreement between you and Solarhi Tech regarding our services.

11.2 Force Majeure

Neither party shall be liable for delays due to causes beyond their reasonable control, including natural disasters, government actions, supply disruptions, or other force majeure events.
